All of those in the construction industry are familiar with EquipmentShare.com Inc. It has rental, retail, and service locations across 45 states. From their website, they declare that their mission is “[t]o enable the construction industry with tools that unlock substantial increases to productivity. Together with our team and customers, we are building the future of construction.” A Texas corporation, EquipmentShare’s principal location is in the City of Columbia, Boone County, Missouri. Presumably, because of this principal location, the Commercial Credit Application used by Equipmentshare throughout the the United States sometimes includes a choice of law provision selecting Missouri law to govern the contract. In addition, the Application also sometimes includes a venue selection clause selecting the state and federal courts of Missouri as the exclusive jurisdiction for any lawsuits arising from the Application. And when the Guaranty is signed, it sometimes includes a requirement that all suits relating to the Guaranty be filed either in Boone County, Missouri, or Dallas County, Texas. While we do have any any stats about Texas cases, a search done on October 5, 2026, on Missouri’s case.net system for civil cases involving “Equipmentshare” filed in 2026, returned 594 results, the vast majority of which are suits on account at both the Circuit Court level or the Associate Circuit Court level.
Rogers, Ehrhardt, Weber & Howard’s main office is also located in the City of Columbia, Boone County, Missouri, and we have been defending cases at the Boone County Courthouse since our founding in 1984. If you or your company have been sued by EquipmentShare in Boone County and are in need of a local attorney, contact Principal Attorney James Howard via email to discuss possible representation.
